These Terms & Conditions are the travel agreement for the Les Voyages de Chantal excursion offered by Chantal’s Cheese Shop LLC (“we,” “us,” or “Chantal’s”). The published trip listing and itinerary, travel dates, total price and currency, occupancy selection, and included services shown before payment are part of this agreement; retain a copy of them and these terms. A “voyager” is a person participating in the trip. By affirmatively checking the acceptance box and purchasing, the purchaser agrees to these Terms and Conditions for themselves. Each voyager must accept and sign these terms and conditional registration will not be considered complete until this form is submitted along with payment for each voyager. Please inform us if you purchase on behalf of someone else and their contact information and we will provide a copy of these Terms and Conditions and booking details electronically to you and them for additional signature.
The total price and payment amount due at booking are those displayed before checkout and recorded in the booking confirmation. Credit card fees may be charged at checkout and are non-refundable.
The itinerary or booking confirmation and subsequent communications will identify the dates, times, and meeting instructions. Alcohol service is subject to applicable local rules and host discretion.
The package does not include airfare or other round-trip transportation to or from the designated trip meeting point travel insurance, personal shopping, discretionary gratuity, transportation before arrival at the designated pickup location or after the tour ends at the designated hotel or end point, or accommodation outside the nights provided in the package. Except for items expressly included in the itinerary, travelers are responsible for their own incidental and personal expenses or any expense not outlined as included.
Do not rely on a conditional reservation when purchasing nonrefundable airfare or other independent travel. We recommend waiting for our written go/no-go confirmation or choosing refundable arrangements. We cannot reimburse independent bookings solely because the minimum group size is not reached, except as required by law.
Each voyager must be at least 21 years old on the voyage start date of the trip. No person under 21 may join transportation, lodging, or activities. A booking for an ineligible voyager is subject to Section 4; an ineligible voyager who arrives will not be permitted to participate.
Voyagers are solely responsible for determining their suitability for the trip including level of fitness, state of health, and overall condition for travel and participation prior to booking the trip.
After purchase, we will email each voyager a Voyager Information Sheet to collect travel, emergency-contact, and relevant health or dietary information. This is an information form, not a separate contract, and does not amend these terms. Each voyager must return it within 10 days of receipt and personally accept these terms electronically if they did not do so at checkout.
Payment secures a conditional reservation; the trip is finally confirmed only when payment, each voyager’s acceptance and information sheet, and the minimum participation threshold have been received or met.
To ensure a high-quality, fully supported experience for all participants, we require a minimum number of confirmed guests before departure. We will make and communicate a written go/no-go decision at least 90 days before departure. If that number is not reached by the decision date, we may cancel under Section 3 or offer an alternative date or itinerary, which a voyager may decline in favor of a full refund. If paperwork is missing, we will give written notice and a reasonable opportunity to cure before cancelling that person’s reservation. We will refund any payment paid directly to Chantal’s if we cancel for failure to reach the threshold under this Section; otherwise cancellation and refund rights are governed by Sections 3 and 4 and applicable law. Chantal’s is not liable for any third-party cancellation costs incurred by a voyager.
Chantal’s primary goal will be to deliver a travel experience that delivers the unique perspective outlined in our voyage descriptions. From time to time, however, situations may arise that present difficulties or make the trip infeasible, in part or in whole. We reserve the right to alter trip plans, including but not limited to, activities, visits, and lodging accommodations; or, to cancel the trip in its entirety, including but not limited to the following reasons:
In the event we alter the plans, we will do our best to fulfill the thematic intent of the trip but make no guarantees of specific experiences. We will communicate these alterations in a clear and consistent manner, but prior voyager approval is not required.
If Chantal’s cancels the entire trip before it begins, each affected voyager may choose either (a) a full refund of the package price paid to Chantal’s, except for any credit card or other processing fees, or (b) transfer of the amount paid to another voyage, if one is available and the voyager agrees. Chantal’s will not require a voyager to accept a transfer. We are not responsible for separately purchased airfare, lodging, or other independent arrangements.
If an event beyond Chantal’s reasonable control materially interrupts the trip after it begins, Chantal’s will notify affected voyagers promptly when reasonably practicable, explain the interruption, and make reasonable efforts to arrange appropriate alternative services where feasible.
In the event of alteration or cancellation, we will notify voyagers in a timely manner at the contact information provided at booking.
A voyager who cancels both within 30 days after purchase and at least 120 days before the voyage start date may request a refund of the package price paid less a 4% administration fee and any credit card or other processing fees. Outside that combined window, the package price is nonrefundable except where Chantal’s cancels the voyage under Section 3. Additionally, there is no proration or refund for activities or tour days missed by a voyager after the trip begins, except as required by applicable law.
If one voyager of a double occupancy selection cancels, then the remaining voyager may choose to 1) register an eligible replacement who personally accepts the terms, (2) keep the room at a single-occupancy price and any cancellation refund would be prorated appropriately, or (3) cancel under the cancellation rules applicable to their own booking. The remaining voyager must provide notice of their election, and payment should they choose option 2, within ten (10) days of their shared occupancy voyager’s cancellation and at least 72 hours before 90 days before the trip. This is subject to single occupancy availability, Provider terms and availability, and proximity to trip start date.
A cancellation request must be sent to chantalscheese@gmail.com; we will use the date it is received to determine eligibility. Upon request, and in our sole discretion, we may permit a reservation to transfer to another eligible voyager or another available voyage date. A transfer is not guaranteed, and any substitute voyager must satisfy the eligibility and registration requirements. Please ask about a proposed transfer before making arrangements with another traveler. Only voyagers registered with Chantal’s and with valid accepted terms will be permitted on the voyage.
The cancellation schedule reflects advance commitments for lodging, transportation, hosts, and planned experiences. It is subject to any nonwaivable rights under applicable law.
Food experiences may involve common allergens, including milk, eggs, peanuts, tree nuts, wheat, soy, fish, shellfish, and sesame. Please disclose allergies and dietary restrictions before booking so we can discuss the itinerary and whether an accommodation may be feasible. We cannot promise an allergen-free environment or guarantee the practices of restaurants and other independent providers. Providing dietary information does not itself confirm an accommodation; we will communicate any accommodation we agree to provide. Voyagers remain responsible for choosing what they consume and for seeking medical advice about their own needs.
Alcohol may be offered in moderation at meals and designated tastings. Voyagers may decline alcohol, however, no proration or reduction in price is made for declining to partake in alcohol. No voyager may participate while impaired in a way that threatens their own safety, another person’s safety, or the safe operation of the tour. Illegal drugs are prohibited during the voyage, including in tour vehicles and at tour activities and lodging, and voyagers must comply with the laws and policies of every location visited. Prescription medication may be carried and used as lawfully permitted; each voyager is responsible for confirming applicable travel, customs, and local requirements. Voyagers must respect local laws, regulations, and ordinances, hosts, other voyagers’ privacy, and reasonable group instructions. We may refuse participation in an activity, or remove a voyager from the tour, for violation of this policy, harassment or threatening conduct, or conduct that poses a material safety risk or substantially disrupts the group, after taking reasonable steps appropriate to the circumstances. We will explain the reason to the voyager when practicable. Removal for a voyager’s violation does not entitle that voyager to a refund for unused portions, except as required by applicable law.
Travel and shared activities carry risks of exposure to communicable illnesses, including COVID-19, influenza, colds, and norovirus. We cannot eliminate those risks. Voyagers should consider their health needs before booking and follow reasonable safety directions during the tour. If a voyager becomes ill, they should promptly tell the host, take reasonable steps to avoid exposing others, and seek medical care as appropriate. Where reasonably necessary to protect the group, we may require an ill voyager to refrain from a particular activity and assist with arranging care or alternative plans; we will not diagnose or promise medical treatment. Additional personal medical and accommodation costs remain the voyager’s responsibility except to the extent caused by our legal responsibility. Refunds are not granted if a voyager needs to cease participation for illness. Nothing in these terms excludes liability that cannot lawfully be excluded.
The trip may involve walking on uneven ground at farms, vineyards, trails, and cobblestone areas, and navigating stairs or inclines. Some activities may involve moderate exertion, including e-biking if included in the itinerary. Voyagers may need to carry or roll their own luggage, walk on cobblestones, climb stairs, and board and exit vehicles without continuous assistance from tour staff. Voyagers should be aware that the Americans with Disabilities Act does not apply outside of the United States and facilities outside the U.S. for disabled individuals are much more limited. Facilities and amenities, including elevators and Wi-Fi, may vary. Voyagers with mobility or assistance questions should contact us before purchase for trip-specific information. We will discuss reasonable available arrangements, including participation with a companion if appropriate, but cannot promise that every site or activity is accessible. We will not require a companion categorically without considering the voyager’s circumstances and applicable law.
Voyagers are responsible for travel documents and for travel to the designated trip pickup location and from the designated final hotel or end point after the tour. We recommend travel insurance that may cover cancellation, travel disruption, medical treatment, and evacuation. Each voyager should review policy exclusions and coverage independently; we do not provide insurance, advise on insurance, or guarantee a particular policy’s coverage.
You agree that Chantal’s may use, re-use and reproduce any images, photos or videos that you send to us or are taken by us, our guides, staff, contractors and/or other voyagers of you individually or in a group (and provided to Chantal’s), in any medium, including but not limited to print, electronic media, or Internet, free of charge in perpetuity, and without your right to inspection, for the purposes of promoting and publicizing our business and services worldwide.
A voyager may opt out of promotional use of their identifiable image by notifying us in writing before the voyage begins at chantalscheese@gmail.com. We will make reasonable efforts to honor that choice for images we control; we cannot control images independently taken or published by other voyagers or third parties.
Each voyager is responsible for obtaining and carrying a valid passport and any required visas, entry permissions, health documents, and personal medications, and for checking applicable requirements with the relevant authorities before departure. We do not guarantee admission to a country or venue. Voyagers must arrive at the designated meeting point on time and follow reasonable group instructions as well as notify us promptly of delays or emergencies. We will make reasonable efforts to assist a delayed voyager in rejoining the tour, but any additional transport or accommodation a voyager arranges because of a missed pick-up or voluntary departure is at that voyager’s expense.
Except as to when Chantal’s owner or staff member is actively leading an activity, meaning being the main leader/provider of the experience, without limiting liability for location, hotels, restaurants, activity sites, locations, carriers, and activity hosts are independent providers (“Providers”). A particular host, location, or guide is not guaranteed. If a Chantal’s owner or staff member is present during an experience but not leading it, they are not a host. Voyagers acknowledge that you are aware and clearly understand that these Providers are independent contractors and are not managed by Chantal’s nor are they agents or employees of Chantal’s. Chantal’s is not responsible for any damages or claims made in connection with these Providers. A Provider’s services are subject to their own terms and conditions and the local laws and regulations of their respective country.
If a service problem arises, voyagers should tell the tour host promptly and, if unresolved, email chantalscheese@gmail.com with the booking information and a description of the issue. We will make reasonable efforts to investigate and offer an appropriate solution while the trip continues. Reporting helps us address the issue but does not guarantee a specific outcome.
As mentioned above, activities may involve inherent risks, including uneven terrain, vehicle travel, and, where offered, cycling. A voyager may decline an optional activity without forfeiting other included services; no separate refund for a declined activity is promised unless the booking expressly identifies one. Voyagers must follow reasonable safety directions and disclose to the relevant Provider information needed to safely participate. In an emergency, we may contact the emergency contact supplied, arrange reasonable assistance, and share necessary information with responders and providers. The voyager remains responsible for personal medical and evacuation costs.
PLEASE READ: THIS SECTION LIMITS CERTAIN LEGAL CLAIMS. Participation in this voluntary trip may involve slips or falls on uneven terrain or stairs; injury during walking, cycling, or transport; exposure to food allergens or communicable illness; and injury during tours, workshops, or tastings. Serious injury may occur, up to and including, death. Each adult voyager chooses whether to participate in a particular activity and accepts the inherent risks of participating.
To the fullest extent permitted by applicable law, each adult voyager releases Chantal’s Cheese Shop LLC and its owners, employees, and agents (“Releasees”) from claims for the voyager’s personal injury, up to and including death, or property damage occurring during the trip, including claims based in negligence, in arranging or conducting the trip’s included group activities and transportation. This expressly includes claims that Chantal’s or its staff failed to exercise reasonable care in selecting or retaining an independent hotel, carrier, restaurant, guide, or activity provider for the trip, or in coordinating that provider’s included services, when that failure causes the voyager’s injury or property damage during the trip.
We use booking and Voyager Information Sheet details to administer the trip, arrange services, address safety and dietary requests, and communicate with voyagers. Voyagers are responsible for providing accurate personal information and spellings. We may share information reasonably necessary for these purposes with lodging, transport, food, activity, and emergency-service Providers, including providers outside the United States. Do not include more sensitive health information than is needed to communicate a requested accommodation or emergency need. We will take reasonable steps to protect information in our possession and will handle it under our applicable privacy notice and law. Promotional image use is addressed separately in Section 7.
The responsibility of Chantal’s is strictly limited. Chantal’s is not responsible for any injury, loss, or damage to person or property, death, delay, inconvenience, or any failure to perform its obligations under this Agreement as a result of a cause beyond its control, including, but not limited to, (1) acts of God, (2) war, including armed conflict, (3) strikes or labor disputes in the designated trip country (4) disease or virus in the designated trip location (examples include, but are not limited to, SARS, Legionnaires, Covid19), (5) government regulation or advisory (including travel advisory warnings), (6) civil unrest or disturbance in the designated trip country (7) terrorism or threats of terrorism as substantiated by governmental warnings or advisory notices, (8) curtailment of transportation services or facilities which would materially affect attendees from attending the tour, (9) disaster, fire, earthquake, hurricane in the designated trip country (10) unseasonable extreme inclement weather in the designated trip country (11) shortages or disruptions of the electrical power supply or other essential utilities causing blackouts or rolling blackouts in the designated trip country or (12) any other cause, whether similar or dissimilar to any of the foregoing, which could not have been prevented by such party with reasonable care (each, a “Force Majeure Event”). Within five (5) days of the occurrence of a Force Majeure Event, Chantal’s shall notify voyager of the occurrence by sending an e-mail message to the email address provided by voyager. In addition, Chantal’s shall provide to voyager, within seven (7) days of determining the cause of a Force Majeure Event, any adjustments to the voyage, up to, and including cancellation. In the case of any cancellations for a force majeure event after commencement of the voyage, Chantal’s will communicate any eligible refunds, which are subject to Provider costs, trip commitments, and extent of the Force Majeure Event’s affect on the trip.
A voyager is responsible for loss or damage to persons or property to Chantal’s or a third party to the extent caused by that voyager’s unlawful conduct, willful misconduct, or negligent damage to property. To the extent permitted by applicable law, the voyager will indemnify Chantal’s and its owners, employees, and agents against third-party claims arising from that conduct, but not to the extent a claim results from Chantal’s own negligence, misconduct, or breach of these Terms & Conditions.
Notices under these terms may be emailed to the address supplied at booking; voyagers must keep their contact details current. Send cancellation requests and questions to chantalscheese@gmail.com. These terms and the booking details constitute the agreement for the trip; the information sheet does not add contract terms. If any provision is unenforceable, the remainder continues to apply to the extent permitted by law. Nothing limits mandatory consumer protections or remedies. Jurisdiction shall lie in the applicable courts of Allegheny County, Pennsylvania. However, no choice-of-law or forum provision is intended to override any nonwaivable protection applicable to the trip.
At Chantal’s Cheese Shop, we believe in fresh cut cheese, which means we cut each order by hand to ensure the freshest product. We strive for accuracy, however we are humans not machines. In our shop, we get to say things like, “hey, so this is more like a 1/3 of a pound” and you get to say “oh, I’m sure we can find a way to deal with that.” And we all laugh.
We don’t get to have that laugh online. Instead, we have a 25% overage that we estimate for each item you purchase that is priced by weight. Once we’ve prepared your order, we will charge based on the actual weight of your products, so that you’re paying for what you’re getting. This also means that we do not finalize payment until the day of the order, so you may see the charge as pending until up to a few days after the pickup or delivery date.
